TERMS AND CONDITIONS
Definitions
This Agreement is between Creative Escape (“We” “Us” (“Our”) and [You] (“Participant”) which includes the participant’s heirs, administrators, executors, successors, and assigns for all family members. You agree that You have the legal authority to enter into this Agreement.
General Terms
By participating in the Creative Escape you agree to these terms of service upon paying registration. You acknowledge and understand that there are or may be inherent risks in participating in the Creative Escape and your registration constitutes a release of liability and full assumption of all risks by You, your heirs, administrators, executors, successors, and assigns for all family members. By accepting our terms and conditions, you acknowledge that you are aware that travel, “wherever and by whatever means”, involves some inherent risk of injury, illness, death, loss, or damage to personal property, which may be caused by forces of nature, negligence or acts of others.
In consideration and as part of the payment for your participation in the Creative Escape, you voluntarily release the hosts, their employees, agents, independent contractors, or any parties thereto, from any and all damages, liabilities, costs, injuries, mental or physical, known or unknown, and by your participation, you agree to assume all risks, known or unknown. You voluntarily acknowledge that the trip may take you to remote, foreign, mountainous, coastal, or wild areas which may not be of the standard to which you are accustomed and therefore may involve certain additional risks, dangers, and inconveniences, including but not limited to; terrorism, forces of nature, wild animals, hotel accommodations, aircraft, vehicles, trains, boats, roads, trails, paths and other means of transportation or other unknown risks. You acknowledge that medical services and facilities, such as medical care, the presence of medical professionals, and medications may not be readily available during all or any part of the Creative Escape. Creative Escape hosts assume no liability for medical care.
You also acknowledge that you understand that traveling with a group always requires compromise to accommodate the variety of desires, destinations, personalities, and physical abilities of the group members. You also understand that while itineraries are carefully planned, they are not a guaranteed schedule of activities, events, or participation, but are merely a guideline and example. Group participants must be flexible and allow for changes as deemed necessary by program leaders or professional tour guides. Due to geographic, climatic, physical, or governmental constraints, situations beyond our control may arise, resulting in further changes to the schedule, locations, and activities. You understand and agree that there are no discounts or refunds for activities that are curtailed or otherwise affected due to such circumstances.
You assume the responsibility for choosing an activity that suits your physical abilities and interests. It is your responsibility to determine whether or not you are healthy enough to participate in the activity. By accepting our Terms and Conditions and by making a deposit, you certify that you do not knowingly have any physical or other disability that would pose a risk to you or other participants.
You are responsible for the following: (i) reviewing all pre-trip information provided prior to the trip; (ii) bringing all equipment, personal items, and appropriate clothing; (iii) adhering to the dress code and hygiene standards; and (iv) being considerate of other participants, locations and environments, models and places.
We reserve the right to cancel any activity and to accept or reject any person as a member of an activity. The judgment of the program, workshop, expedition, field trip, or tour leader is the final decision on a person's ability to participate or continue to participate in an activity or program.
Cancellation or Changes
We strongly recommend that you purchase cancelation and travel insurance after booking your trip.
We understand the importance of providing clarity regarding our payment and cancellation policy. Therefore, we would like to inform you that we offer two options for payment.
The first option is to make the full payment in a single installment at the time of booking, either right after an online call with us or by paying a 50% deposit. In this case, the remaining balance can be paid in two separate installments, up to two months before the date of the workshop.
A minimum of a 50% deposit is required to secure your spot, as we may need to make advance payments to our suppliers, such as for permits and transportation companies. Please note that the deposit is only refundable within 48 hours after booking.
Once you have made the remaining payment for your trip, you may be eligible for a refund under certain circumstances. If you cancel and the workshop is filled with another participant, we will refund the full amount paid, minus an administration fee of 150€. If the workshop does not take place, you will receive a refund based on the full fee paid for the workshop.
If you cancel, we will provide refunds according to the following schedule:
1. If you cancel more than 90 days before the start date of the workshop, you will receive a full refund minus a 150€ service fee.
2. If you cancel 60 days or more before the start date of the workshop, you will receive a 50% refund of the full amount paid, minus a 150€ service fee.
3. If you cancel 30 days or more before the start date of the workshop, you will receive a 25% refund of the full amount paid, minus a 150€ service fee.
4. If you cancel less than 30 days before the start date of the workshop, there will be no refund.
Please note that any refunds will be made by the same method as the original payment. We strongly recommend that you purchase cancellation and travel insurance after booking your trip to ensure that you are fully protected in case of unforeseen circumstances.
A legal language version of our trip cancellation is as follows:
We reserve the right to cancel any trip, at any time, prior to the scheduled departure date for any reason, including without limitation; insufficient participation, inclement weather conditions, or logistical problems that, in our sole judgment, may impede trip operations. In the event that we cancel your trip for any reason other than a force majeure event, your sole and exclusive remedy shall be a refund of all payments We received from you as of the date of cancellation. Algarve Phototours’ payment of the refund shall release Us from any and all other or further liability that is in any way, related to such cancellation.
We may make payments to our suppliers (permits, transportation companies, etc.) far in advance of the scheduled trip departure date. Accordingly, if a trip is canceled due to a force majeure event (e.g. acts of God, war, labor strikes, earthquake, flooding, or any other cause beyond our control), We will undertake commercially reasonable efforts to promptly refund the portion of any amounts paid by you that have, in turn, not already been advanced to suppliers. Additionally, We will use commercially reasonable efforts to recover and refund to you the balance of your payment amounts that were advanced to suppliers, less our expenses, if any, of such recovery, as promptly as possible. However, we do not guarantee you recovery of any portion of advance payments made to our suppliers.
Use of Name and Likeness
We reserve the right to take photographs or make videos during the operation of any workshop or portion thereof, and to use any resulting recordings in whole or in part, for promotional purposes, including but not limited to; advertising and publicity in both print and electronic media. By booking a tour with Algarve Photo Tours, You consent to your image being used for such photography/videography. Participants who prefer that their image not be used will be asked to identify themselves to the hosts at the start of the trip.
Not Included
Airline tickets to and from the starting point, passport and visa costs, baggage, accident and trip cancellation insurance, personal expenses such as laundry, telephone calls, meals, alcoholic beverages, and any other items not specifically listed as included.
Travel Documentation
You are responsible for ensuring that you have the correct documents to enter the country where the workshop is taking place.
Insurance
We recommend that you get travel insurance for the event. Please check the terms and conditions carefully. Travel insurance often covers losses in the event of travel cancellation and interruption, travel delay, loss of baggage and travel documents, baggage delay, medical emergencies, and accidental death.
Third-Party Services
You understand that in providing the services associated with the Creative Escape, we are assisted by transportation providers, lodging operators, and dining providers. We cannot control the actions of these third parties and accept no responsibility for unforeseen events, including but not limited to; travel delays, lost luggage, cancellations, overbooking, and other booking errors that may occur. You should allow for some flexibility in your schedule in the event that we need to extend the duration of the Creative Escape or make other reasonable schedule changes to accommodate unforeseen events such as travel delays, lost luggage, cancellations, overbooking, and other booking errors. In the event of unforeseen events which require a schedule change, You will not receive a refund or compensation. You further agree to hold Creative Escape harmless from any liability for any injury, death, damage, loss, accident, delay, or irregularity that may occur in connection with the services provided by third parties.
